Rent receipts are the primary document required to claim HRA (House Rent Allowance) exemption under Section 10(13A) of the Income Tax Act. The exemption amount is the minimum of: (a) Actual HRA received from employer; (b) 50% of basic salary for metro cities (40% for non-metro); (c) Actual rent paid minus 10% of basic salary. Without valid rent receipts, your employer cannot reduce TDS on salary โ and you lose the exemption unless you file ITR manually with proof.

Pay Rent by Bank Transfer or UPI โ Not Cash โ for Proof of Payment
While cash rent receipts are legally valid, Income Tax department scrutinises cash rental transactions above โน8,333/month in IT scrutiny cases. CBDT prefers bank-evidence transactions. Always pay by UPI (GPay/PhonePe), NEFT/IMPS, or cheque โ it creates an automatic digital audit trail. Your bank statement + rent receipt together create irrefutable proof. If using UPI, mention the UPI transaction reference number on the receipt.
Submit Rent Receipts Before January 31 โ Not at Year-End
Most employees submit HRA proof in February/March just before ITR filing. But for your employer to adjust TDS on salary, you must submit Form 12BB and rent receipts by January 31 of the assessment year. Late submission means employer cannot reduce TDS โ you pay more TDS and then claim refund in ITR. Rent Agreement is Not Mandatory โ But Strongly Advisable for Rent Above โน20,000/month
No law requires a rent agreement to claim HRA. But Income Tax notice recipients (in scrutiny assessments) who can produce a notarised rent agreement have zero issues substantiating their claim. For rents above โน20,000/month (โน2.4L/year), always have a registered or notarised rent agreement. โน100 stamp duty + โน500 notary fee is worth the protection. If Landlord Refuses PAN โ Claim HRA in ITR Manually with Form 10BA
Many landlords (especially elderly or informal landlords) refuse to share PAN. In this case: (1) Employer cannot grant HRA exemption โ full TDS will be deducted; (2) You can still claim HRA exemption while filing ITR โ submit Form 10BA (self-declaration of rent paid) with your ITR; (3) Attach your rent receipts and bank payment proof to ITR filing; (4) You’ll receive refund of excess TDS after ITR processing. Form 10BA is available at incometax.gov.in and in your ITR filing software. Do not forgo the exemption just because your landlord won’t share PAN.
Backdated or Fake Rent Receipts are a Tax Fraud โ Heavy Penalties Apply
Creating rent receipts without actually paying rent (or creating backdated receipts) is a tax fraud under Section 277 of the Income Tax Act โ punishable by 3โ7 years imprisonment and heavy penalties.
